Biography

John H. Chun is a partner in Herrick's Litigation Department. He is a seasoned litigator who handles commercial, employment, trade secret, real estate, partnership and trust and estates disputes. His clients include private equity and hedge funds, startups, C-suite executives, technology and healthcare companies, and insurance companies and brokers.

Prior to joining Herrick, John practiced at Quinn Emanuel Urquhart & Sullivan. He was also a trial lawyer at the Federal Public Defenders Office, adjunct professor of law at the University of Maryland School of Law, and law clerk to the Hon. Thomas J. Meskill of the United States Court of Appeals for the Second Circuit.

Commercial Litigation

John’s commercial litigation experience spans all phases of disputes, including trial and appeal. Recent successes include:

  • Dismissal of claims for breach of licensing agreement and tortious interference in a multi-million dollar shareholder dispute, along with dismissal of parallel JAMS arbitration;
  • Dismissal of multi-million dollar deferred compensation claim by a former executive in a AAA arbitration;
  • Denial of motion to dismiss in a construction defect case alleging fraud against condominium developers and their principals;
  • Appellate reversal of a lower’s court denial of a motion to dismiss claims in a shareholder dispute; subsequently awarded summary judgment dismissal of remaining claims;
  • Trial defense of an international manufacturer against a multi-million-dollar breach of contract claim after which client was awarded attorneys’ fees, expenses and costs.

Employment Mobility and Trade Secrets

John is an authority on the law of trade secrets and restrictive covenants, and frequently publishes and speaks in these areas. He regularly counsels employers and employees on the drafting and enforcement of employment agreements, including restrictive covenants. He frequently appears on his clients’ behalf in pursuit or defense of TROs and preliminary injunction motions in trade secret misappropriation matters. In a recent trade secrets theft matter, John successfully obtained a TRO and preliminary injunction against a departing executive and his new firm.

Real Estate Litigation

John also has extensive experience representing clients in real estate disputes, including lenders, borrowers, condominium boards, developers, investors and owners. He is currently representing the Condominium Board of a luxury development in Midtown Manhattan in connection with construction defect and fraud claims against the Sponsor and its principals.
