FTC Issues Non-Compete RFI as Trump Admin Moves Toward Case-by-Case Prohibitions

Herrick partner, John H. Chun, was quoted in IPWatchdog discussing the Federal Trade Commission ("FTC") announcing that it will end its efforts to enforce its ban on non-compete agreements.

The article noted that the "FTC appears to already be shifting toward a case-by-case approach toward addressing non-compete abuses."

John said that "with the demise of the FTC’s ban, states will continue to play the leading role in setting rules-of-the-road for non-competes," with the trend toward preventing such agreements likely to continue.

The FTC’s action against Gateway Services indicates that the Trump Administration will continue taking action against non-competes, especially those restricting low-wage workers, John added.
