- Obtained dismissal on behalf of borrower-defendants of civil RICO action brought by non-institutional commercial lender alleging scheme to abuse New York’s usury laws.
- Obtained dismissal of multimillion dollar claims for breach of commercial lending agreement, fraud, breach of fiduciary duty, and several equitable remedies on behalf of borrower client. Defeated Plaintiff’s motion for prejudgment order of attachment and Plaintiff’s two motions for leave to appeal to the New York Court of Appeals in the same litigation.
- Obtained dismissal on behalf of high-net-worth offshore family trust in action for breach of contract, fraudulent conveyance, and unjust enrichment brought by foreign lenders to recover approximately $60 million.
- Obtained dismissal on behalf of property owner in $35 million dispute over alleged oral joint venture agreement to develop or sell high-end property in Manhattan.
- Represented family investment office of high-net-worth foreign political dissident, whose assets were unlawfully expropriated by a foreign government, in domestic and international litigation.
- Obtained complete dismissal under New York anti-SLAPP statute of claims brought by condominium board, developer, and sponsor against unit owner.
- Obtained dismissal of plaintiff’s claims under Title III of the Americans with Disabilities Act and New York State Disability Laws for vertical access between floors of prime SoHo retail store.
- Obtained judgment in favor of landlord for full amount of rent due in plenary breach-of-contract action for nonpayment of rent by commercial tenant. Obtained dismissal of all but one tenant’s claims in related action by tenant for, among other things, breach of contract, partial constructive eviction, breach of the covenant of quiet enjoyment, nuisance, conversion, trespass, negligence, and declaratory relief.
- Represented music streaming and technology company in breach of contract action over royalty dispute.
- Represented purchaser of commercial property in action by seller for rescission, fraud, conspiracy to commit fraud, breach of fiduciary duty, conversion, and unjust enrichment with respect to purchase of $11 million investment property in Long Island City.
- Obtained dismissal on behalf of menswear retailer in action for false association under the Lanham Trademark Act and New York State Civil Rights Law.
