NY Rule Paves Way For Remote Trials In Commercial Disputes

Herrick litigation partner Scott E. Mollen spoke to Law360 about remote court hearings and trials. In October of 2021, Chief Administrative Judge Lawrence K. Marks signed off on the directive — Rule 36 — which gives litigants who consent to it the option to participate in evidentiary hearings and nonjury trials remotely. Proponents of the rule say it creates minimum standards for remote proceedings, and it is crucial to preserving New York as a preferred venue for commercial litigation for both domestic and international parties.
