Co-chair of Herrick’s Litigation Department and the firm's General Counsel, Leah Kelman, served as faculty for the CLE course "Bridge-the-Gap II: Ethics and Skills for Newly Admitted New York Attorneys 2025," from the Practising Law Institute ("PLI").

Panelists discussed ways to avoid risks associated with social media with respect to lawyers’ professional obligations to clients.

Discussion topics included:

  • How to evaluate employee social media policy and compliance invoking attorney conflicts of interest issues.
  • How to manage user-generated content including the fiduciary obligations of lawyers.
  • Recognizing evidence for social media with respect to lawyers’ professional relations to courts.
  • Recalling disciplinary procedures for attorneys and recent state bar association ethics opinions.
  • Understanding social media in the courtroom:
    • Juror misconduct and implication of lawyers’ disciplinary rules.
    • Judges, social media and the norms relating to judicial civility.
