4 Lingering Questions as NY Launches Mobile Sports Betting

Irwin Kishner, co-chair of Herrick's Sports Law Group, was quoted in an article in Law360 discussing the legalization of mobile and online sports betting in New York.  Recently, lawmakers legalized mobile and online betting as part of a budget deal through a model "that seeks to give New York direct control over betting operations and a larger share of betting revenue."  

"This is at the nascent stages, so there is a lot to still be figured out," said Kishner. "But I think it was inevitable. Otherwise, New York would continue to forfeit betting revenue dollars to other states. How it is going to work is yet to be seen."

The article further examines the outstanding key questions to be determined, including what the model will look like, the revenue sharing plan with the state and whether the legislation will face constitutional challenges.  The article also discusses when mobile and online betting will ultimately be up and running.  Kishner noted that it was unlikely to happen before this NFL season. "Maybe by the 2022 Super Bowl."
