Seize the Opportunity: Real Estate Sales Under Bankruptcy

May 19, 2020
Zoom Webinar

With bankruptcy filings on the rise, understanding the “section 363 sale” of a debtor’s assets is an important part of capitalizing on opportunities in today’s real estate world. Historically, behemoth companies like Toys R Us and Sears have sold a litany of properties through such a process and it is reasonable to assume that similar sales are on the horizon.

Herrick’s presentation focused on the value-maximizing attributes of a section 363 sale process from the perspectives of borrowers, creditors and outside investors—on critical items such as stalking horse bidders, avoiding and winning valuation disputes and manners in which to track the market for such opportunities.

Herrick’s Restructuring & Finance Litigation Department covered:

• An overview of the section 363 sale process
• The benefits and risks in section 363 auctions
• Avoiding and winning valuation disputes
• Best practices

  • Jeff Hubbard, Senior Managing Director, Structured Investment Sales Division at A&G Real Estate Partners
