NJ Resumes Commercial Landlord-Tenant Trials

Herrick partner and co-chair of the firm’s Real Estate Litigation & Dispute Resolution Practice GroupScott Tross, spoke to Law360 about New Jersey resuming trials between commercial landlords and tenants. The article explained that settlements and trials will be held virtually, unless a matter requires an in-person meeting. The reintroduction of sheriff's sales and evictions has looked different in each county. 

"I would say most of the counties are back to doing sheriff's sales," Scott reported. "For the past several months, we've been able to resume conducting foreclosure sales in a normal fashion." He elaborated that he has had more success with commercial foreclosures.

"We're making progress there's no question about it," he added. "We have sales scheduled, I would say, every other week."

Scott also explained that there is a backlog of cases due to the pandemic shutdown: "The courts are congested right now, there are a lot of real estate-related disputes," he said. "It has been a little bit slow, but I would say we've been able to move our cases along, and it hasn't been 100% normal, but it's been close to normal."
