Judge questions ‘appropriateness’ of de Blasio’s water rebate

Michael Berengarten was quoted in Politico from the court hearing at which he argued for plaintiffs the Rent Stabilization Association of New York City, Prometheus Realty Corp., Portofino Realty Corp. and Tuscan Realty Corp. in challenging the New York City Water Board’s one-time $183 bill credit to owners of one-, two- and three-family homes. Berengarten explained that the Water Board typically applied credits or rebates to people who have demonstrated economic need or in exchange for undertaking conservation methods, and did not have the authority to apply them randomly. "There was no rational basis," he said. "The water board did not have the authority under its enabling statute to issue the bill credit."
