Judge Suspends NYC Water Bill Rebate, Rate Increase

The New York Law Journal reported on Herrick’s representation of the Rent Stabilization Association of New York City, Prometheus Realty Corp., Portofino Realty Corp. and Tuscan Realty Corp. in a lawsuit against the New York City Water Board. The suit charges that the Water Board acted outside its authority when it passed an unjustified 2.1% water rate increase, and a one-time $183 bill credit for 1-3 family homeowners, but not for owners of apartment buildings, condominiums and cooperatives. Herrick partners Michael Berengarten and associate Jared Newman secured a temporary restraining order in Manhattan Supreme Court to block the rate actions until another court hearing.
