Insurer Wants Help Covering $900K Discrimination Settlement
Herrick partner and chair of the Insurance & Reinsurance Group, Alan Lyons, was quoted in Law360 discussing his client, Housing Authority Risk Retention Group Inc. (HARRG). HARRG is seeking for Atlanta-based RSUI Indemnity Co. to pay half of the $900,000 payment made to settle housing discrimination claims against the Housing Authority of the City of Annapolis, according to the suit, as both insurers agreed to defend their mutual insured.
Alan explained that HARRG and RSUI equally shared the cost of the Annapolis Housing Authority’s defense in the underlying suit and that his client believes that RSUI similarly had a duty to pay an equal share of the settlement amount. He stated, "HARRG therefore looks forward to obtaining reimbursement from RSUI for its 50% share of the underlying settlement."
