Jury Got Bad Instructions In Contract Row, NJ Court Says

Herrick partner David King is quoted in a Law360 report on Herrick’s successful representation of client Blinds-to-Go before the New Jersey Appellate Division which resulted in the reversal of a jury verdict and damages award.  In a published opinion remanding the construction contract dispute for a new trial, the appellate court agreed that “the jury instructions and verdict sheet both misstated the applicable legal principals of contract law,” leading to a verdict  in which the contractor was found to have breached its contract with our client yet nonetheless received an award on a services-rendered basis, which only applies in the absence of a binding agreement.  Commenting on the ruling, David tells Law360; “We are pleased with the Appellate Division decision, and expect that if the plaintiff goes forward with the case following reversal, the conclusion will be the same.”  To access the full article, please follow the link
