Herrick & JMH Development Achieve Trial Victory in Dispute Over Luxury Residential Development
William R. Fried, partner and co-chair of Herrick's Litigation Department, and partner Shivani Poddar represented JMH Development, the managing member in a joint venture created to develop a luxury residential development in Miami, Florida against PSB, the joint venture’s partner, who asserted false claims including breach of contract and fiduciary duty, among others.
We are pleased to share that after a lengthy and contentious litigation culminating in a 3-day bench trial, which unfortunately delayed the development project, on April 7, 2022, Justice Masley ruled in favor of JMH Development on every single claim and issue and dismissed the case.
“We are thrilled with the Court’s decision,” said Fried, lead counsel for JMH Development. “In addition to Justice Masley’s ruling in favor of JMH Development across the board, the Court awarded our client attorneys’ fees. This is a big win for our client and demonstrates the egregious nature of the claims made against them.”
JMH Development has renewed the entitlements for the project. Jason Halpern, Principal of JMH Development said, “We had unwavering confidence in this project and that the PSB allegations were false. The decision to renew was an easy one and we look forward to completing this high-quality project.”
