Daily Fantasy Ruling Could Spur Change to NY Gambling Ban

Law360 interviewed co-chair of Herrick's Sports Law Group, Irwin Kishner, on the recent New York State Appellate Court ruling that daily fantasy contests violate New York State's constitutional provision prohibiting gambling. The article notes that the ruling could push lawmakers to change the state's constitutional gambling expansion and that the constitutional question will continue to impede state lawmakers' abilities to welcome new forms of sports-related games and wagering in the state. " I really always thought that was the best way to deal with this issue once and for all,  . . .  just go through the constitutional process," said Kishner. "It has been done before. It takes time, but that is the way to go."
