Ruling Bars Arbitrator From Modifying Original Award

The New York Law Journal reported on Herrick’s successful representation of the defendant in an Appellate Division, Second Department appeal, which affirmed an earlier Kings County Supreme Court decision overturning a Beth Din (Jewish rabbinical court) arbitration award. Although courts rarely overturn arbitration decisions, the Brooklyn appeals panel affirmed the lower court’s ruling that an arbitrator may not modify a final ruling years later based on alleged new information about the prior claim or based on an additional claim. Herrick partner Scott Mollen, counsel Jack Sheridan and associate Janice Goldberg represented the defendant.
