Alan Kaplan presented a CLE seminar at Consolidated Edison's headquarters in New York which focused on legal remedies for large scale end users of defective, or non-conforming equipment. The program, entitled "Product Liability Theories and Their Application to Contract and Warranty Based Remedies," explored questions corporations should consider when faced with widespread failure of purchased equipment, including whether to  pursue damages through product liability type claims or UCC litigation, and how to structure contracts with suppliers to protect against extensive financial losses arising from the installation of defective equipment.
