FRESH Take: Are New York City Grocery Stores Moving Into New Developments?

Partner and chair of Herrick's Land Use & Zoning Group, Mitchell Korbey, was quoted in the Commercial Observer in an article which discussed the advantages and disadvantages in applying the Food Retail Expansion to Support Health (FRESH) program to New York City neighborhoods. As to the benefits of FRESH, Mitch stated, “I think it’s a great example of using the zoning resolution to stimulate the developer providing a public benefit...[t]he zoning resolution can’t resolve all neighborhood issues, but this is one way to help in this area." The article also added Mitch’s thoughts on how to enhance the FRESH program by reducing parking requirements for grocery stores, "[t]hat might improve it on the margins” for developers.
