Copyright Cases To Watch In 2026
Herrick counsel, Barry Werbin, was quoted in Law360 discussing a U.S. Supreme Court case involving the ways in which internet service providers ("ISPs") can be held liable for their customers' infringement, one of the most notable copyright cases to watch for 2026.
The article noted that "the high court held arguments December 1, 2025, that grappled with an appeal of a Fourth Circuit ruling that had led to a $1 billion award against Cox Communications Inc. and in favor of Sony Music Entertainment and other music publishers that sought to hold the ISP liable for the infringing activities of users."
Barry said that the secondary liability question at the center of the case is a "complex, challenging issue," given the mix of statutes and precedent the justices have to address.
