New FMLA Forms and Poster Required by March 8, 2013
March 2013On Feb. 6th, the U.S. Department of Labor (DOL) issued new regulations implementing amendments to the federal Family and Medical Leave Act (FMLA) concerning, among other things, military family leave, flight crew eligibility, and disclosure of genetic information obtained by employers for FMLA purposes. In addition to these amendments, the final rules require employers to use updated FMLA notices and certification forms and a new FMLA poster beginning March 8, 2013.
Employers may access the DOL's new forms and poster on the DOL Web site. Additionally, employers may either use the DOL's model forms or create their own, so long as they do not require employees to disclose more information than what is required by the FMLA.
In light of these new regulations, employers covered by the FMLA should post the new FMLA poster immediately and should review their existing FMLA policies to ensure they are up to date.
