Federal Circuit Upholds USPTO’s Domicile Address Requirement

Herrick counsel, Barry Werbin, authored an article for the International Trademark Association (INTA) Bulletin about the U.S. Court of Appeals for the Federal Circuit upholding the Trademark Trial and Appeal Board's initial refusal to register a mark submitted by an applicant who provided a post office address rather than a valid "domicile" address.

Barry explained that "Domicile" is defined under 37 C.F.R. Section 2.2(o) as “the permanent legal place of residence of a natural person or the principal place of business of a juristic entity.” In Re: Chestek PLLC, 2024 USPQ2d 297 (Fed. Cir. 2024).
