Daniel Etna was quoted in Law360 regarding a bill passed by the New York state legislature to regulate daily fantasy sports. The legislation defines “interactive fantasy sports” as games of skill — exempting them from the New York Penal Law definition of illegal gambling — requires operators to register and pay taxes, and imposes several consumer protection-oriented restrictions. “They have had the sword of the judiciary hanging over them as to whether or not they would be viewed as gambling or an illegal form of gambling, and now you want to talk about hedging your bet and obtaining certainty — this was clearly the best outcome they could hope for in New York as to not have taken one’s chances on how a judge or group of judges will rule on any given day," Etna said.
