NFL Considers Requiring Fans to Sign COVID-19 Liability Waivers to Attend Games

Sports Illustrated, The Athletic and the Score quoted co chair of Herrick's Sports Law Group, Irwin Kishner, on the possibility of the NFL requiring fans who attend games this season to sign liability waivers to protect teams from legal action related to potential exposure to the coronavirus. The article notes that the ironclad nature of these waivers and their ability to protect teams is debatable.  Acknowledging the problematic nature of waivers, Kishner stated that “[w]aivers are governed by state law and speaking very generally and in over broad terms, are typically unenforceable depending on circumstances." Furthermore, “[f]ans attending games, though, are assuming a level of risk by entering a stadium.”
