Is Your Condo Board Falling Short? Here’s How to Take Over.
Herrick partner, Bruce Cholst, was quoted in The New York Times "Ask Real Estate" column with a question from a reader about condominium board elections in relation to the financial management of the building. When noting that their condo board has not held elections in more than four years, and feeling frustrated at the lack of change, there is some recourse.
There are ways to compel an election of board members in your condominium. The article notes that Bruce said, "It’s possible that the board can select a member to fill a vacancy on an interim basis — most bylaws allow this. However, it should also call an annual meeting where an election of board members to full terms can be held."
