Brookhaven IDA votes to seize bus depot for $750M Ronkonkoma Hub project

Co-chair of Herrick's Eminent Domain Practice, Jennifer Polovetsky, was quoted in Newsday discussing how the Brookhaven Industrial Development Agency's condemnation of a Ronkonkoma bus depot was approved to make way for the second phase of the $750 million Ronkonkoma Hub housing and commercial project.

The article states,"The IDA board voted 6-0 to accept a recommendation that the town take a 2.2-acre Hawkins Avenue property owned by North Fork Express, a charter and school bus company located in the middle of the development under construction by East Setauket-based Tritec Real Estate."

The article notes that Jennifer represents the owner of the bus depot and discussed how the town is "expected to prepare an appraisal of the bus property and make a compensation offer to the company," adding that "[the owner] could challenge the town's offer in State Supreme Court in Riverhead and seek additional
compensation." Jennifer said she hopes to negotiate a compensation deal with IDA officials in lieu of condemnation to "to save everybody time and money" and avoid going to court.
