Barry Werbin was quoted in the Las Vegas Sun discussing attempts by local residents to trademark “Las Vegas Raiders.” As the Raiders football team prepares for its move to Las Vegas, some opportunistic individuals thought applying for a trademark for the football team’s name could be an easy way to make some quick money. However, the applications so far have been refused by the US Trademark Office. “Established law tilts heavily toward demonstrated use of the trademark and common sense in that regard,” Werbin explains. “Whatever brand you have, it’s a valuable asset, but you’re also in a sense protecting your consumer base, your fan base, from being confused. The more famous a mark is, the bigger universe they legally have to stop third-party uses.”
