Crew’s dispute over how much information the retailer owes its lenders in the wake of an intellectual property transfer. “What I think is unusual about the posture of this is J. Crew saying, ‘I want a declaratory judgment, meaning a judgment that I’m right as a matter of law, but I’m going to tell you what facts you need to get there.’ That’s not ordinary civil litigation,” said Selbst. “I believe the court will ultimately determine that the term loan agent is entitled to the information requested through the discovery process.”
