Jonathan Adelsberg spoke on a panel entitled, “We Are Not in Kansas Anymore: Unique Issues in City Leasing” at the ICSC Law Conference. Jonathan shared the panel with Eric G. Menkes, a partner at Duval & Stachenfeld LLP in New York. The workshop focused on exclusive issues that relate to urban locations such as Boston, Chicago and New York City where retail is usually on the ground level of residential or office high rise towers. They spoke about new trends in urban locations such as retail condominium units and the legal implications of the condo declaration, building rules and regulations, bifurcated ownership, the bylaws and who provides crucial services to the tenant and what are the respective rights in the event of a project-wide repair and maintenance or default.

Many of our real estate clients have begun to turn their eyes north - to the Bronx. Investors pumped $2.39 billion into Bronx properties in 2014. That's a 39% increase from the previous year and a 55% bump from 2012. Two key segments are also up considerably - multifamily sales are up 67% since last year and sales of development sites are up by 85%. In total, more than $11 billion in private equity has been invested in the borough in the last few years.

The symposium covered legal, forensic, governmental, and political strategies being employed to address the enormity of this global phenomenon. Topics included the history of fakes and forgeries, insurance fraud, art theft and art scams, scientific and forensic approaches, provenance research, cultural repatriation, issues facing auction houses and purchasers, and current case studies. Several Herrick partners joined Yankees alumni, WFAN's Boomer Esiason and Craig Carton, and local players and coaches at the tournament, which in its first four years has raised more than $250,000 for charity.
