Mara has a diverse background, concentrating her practice in complex commercial and real estate litigation as well as employment law. Mara represents private and public companies in both federal and state courts and administrative tribunals and participates in all forms of alternative dispute resolution, including mediation and arbitration.
As Co-Chair of Herrick's Employment Practice Group, Mara represents public and private companies in all types of employment litigation including trade secret, restrictive covenant and unfair competition litigation, ERISA, FLSA and WARN violations, and claims brought under federal, state and local statutes alleging sexual harassment and discrimination. Mara regularly litigates in federal and state courts and before the Equal Employment Opportunity Commission, N.Y.S. Division of Human Rights and N.Y.C. Commission on Human Rights, and defends companies involved in Department of Labor audits and other governmental investigations of labor practices.
Mara's practice also focuses on risk management, advising a diverse client base on personal issues including hiring, firing, reduction in force, benefits, requests for leaves of absence, disability and accommodations, separation packages, and the creation and implementation of exit incentive programs. She counsels clients by drafting, updating and auditing employee policies and manuals, conducting seminars and sensitivity training programs, investigating claims of harassment and discrimination in the workplace, ensuring compliance with federal state discrimination laws, and creating other risk management programs designed to prevent litigation and/or potential liabilities. While Mara services clients in many diverse industries, she has developed a particular proficiency dealing with employment issues unique to the real estate, consumer services, travel and retail industries.
As a general commercial litigator, Mara represents companies and individuals in a wide range of business and complex commercial and contractual disputes including business divorce. As a subset of that practice she also focuses on real estate disputes, representing management companies and real estate developers in connection with claims arising during all phases of development, as well as construction management and operation.
Prior to joining our firm, she practiced law with Cadwalader, Wickersham & Taft. While pursuing her law degree, Mara was the Notes and Comments Editor of the Law Review.
