Hagelthorn v. Kennecott Corporation
1983

Representation of an employee of Kennecott Corporation in an age discrimination action claiming that the employer willfully violated the age discrimination statute. The trial court awarded damages, and doubled them for the willful violation, but refused to award attorneys' fees. We appealed, and the appellate court held that the lower court had no discretion to deny attorneys' fees to a prevailing plaintiff in an age discrimination action. Hagelthorn v. Kennecott Corporation, 710 F.2d 76 (2nd Cir. 1983) (Prior firm experience)
