Clean Harbors - Settlement of Superfund Liability
Clean Harbors purchased Safety-Kleen Services, Inc. out of bankruptcy in 2002, and assumed liability for the Helen Kramer Landfill as part of the deal. In a subsequent adversary proceeding brought against Clean Harbors by other potentially responsible parties, the Bankruptcy Court affirmed Clean Harbors’ assumption of liability in language that went well beyond the specific site. We negotiated a reduction in the amount owed to the PRPs, broadened the scope of Clean Harbors’ release from liability for the site, and assisted in a successful motion to modify the bankruptcy court order. The original order would have been very hard to quantify in Clean Harbors’ public filings and could have adversely affected its financial projections.
