In his weekly Realty Law Digest column, Scott Mollen analyzes two notable cases. In Windsor Plaza v. Pinies, when a tenant put his medical condition at issue the court ordered a tenant to submit to an independent medical examination to explain his absence from the apartment. In the second case Matter of Hernandez v. NYCHA, the court annulled a tenant’s termination of her lease because NYCHA’s violated its internal procedure for terminating a lease.
