In his weekly Realty Law Digest column (subscription required), Scott Mollen analyzes two notable cases. In Lambert Houses Redevelopment v. Jobi, a non-payment proceeding brought by the landlord was dismissed on the basis that HUD failed to comply with federal notice requirements. Landlord’s notices to tenant lacked required information. In Board of Managers of Cathedral Tower Condominium v. Sendar Assoc, a condominium board claimed the sponsor of the condominium had underfunded the condo’s reserve fund by using the incorrect price in calculating it’s funding obligation.
