In his weekly Realty Law Digest column (subscription required), Scott Mollen analyzes two notable cases. In Saint-Jean v. Emigrant Mortgage Co., the court heard an alleged predatory lending case involving discriminatory and abusive mortgage refinance instruments through an equity stripping “no income, no assets” loan program. In NMF Holdings v. First Quality Properties III, the court granted a seller’s motion for summary judgment on counterclaim for breach of contract on the basis that the seller was not contractually obligated to remove declaration of covenants and restriction for ground water management.
