In Estate of Helen Del Terzo v. 33 Fifth Avenue Owners Corp., the court overturned a board’s rejection of co-op shareholder’s sons’ application to succeed to their mother’s apartment. In M. M. & I. Realty v. Gargano, the court relied on NYC Rent and Eviction Regulations to settle a dispute over whether a spouse was entitled to remain in a rent-controlled apartment following her divorce.
