Quijano, the court awarded a landlord possession where a tenant intentionally misrepresented household income. In Bank of America NA v. Lucic, a mortgage foreclosure action, the court granted an order to toll interest charges for the bank’s delay in processing the borrower’s request for a loan modification. In Midfirst Bank v. Agho, the Second Department clarifies the law relating to the conformity of out of state affidavits.
