In his weekly Realty Law Digest column (subscription required), Scott Mollen analyzes two notable cases. In Matter of an Inquiry by Eric T. Schneiderman, Attorney General of the State of New York v. Eichner, the Attorney General obtained an ex parte court order barring sales at a time share hotel pursuant to an ongoing fraud investigation. In American Atheists v. Port Authority, the court rejected atheists’ claims under federal and state law challenging the display in the National September 11 Museum of the “The Cross at Ground Zero” artifact.
