Jefferies Drug Testing Plan Poses Big Risks For Copycats

Mara Levin was quoted in a Law360 story regarding voluntary drug testing undertaken by the CEO and executive committee chairman at Jefferies Group LLC to combat allegations of company drug use, and how she would advise corporate clients that consider implementing a similar program. Levin said, "I counsel against instituting random drug testing, unless there's really a basis to do so, such as safety-sensitive positions where people or the employee could be harmed or suspicion that drug use is prevalent." She added, "I don't recommend an employer conduct any drug testing without a written policy. My recommendation is that there be a policy, and that at least 60 days' notice be given before any policy permitting drug testing is going to be implemented."
