Barry Werbin and Matt Hawkins authored this article, which discusses how the Internet is creating new challenges for musicians seeking to establish and/or protect a band's name and trademark. While technology is making it easier for musicians to market their music to a broad audience, it also increases the potential for disputes over the use of a name by different bands. After reviewing a number of recent cases, the article offers practical advice on how to minimize the risk of a trademark dispute over a band's name.
