Court Halts de Blasio’s Plan to Give Some Homeowners a $183 Credit

Michael Berengarten was quoted in The New York Times regarding the total victory Herrick secured for plaintiffs the Rent Stabilization Association of New York City, Prometheus Realty Corp., Portofino Realty Corp. and Tuscan Realty Corp. in their lawsuit challenging the New York City Water Board’s one-time $183 bill credit to owners of one-, two- and three-family homes. In addition, the judge also ruled the general 2.1% rate increase to all customers exceeded the water board’s authority. “The sole purpose of the rate increase was to fund this bill credit,” Berengarten said. “The water board allowed itself to be co-opted by a political process.”
