New York Employment Law Update: Governor Cuomo Releases Model Sexual Harassment Training Program and Policy

As explained in our employment law update published earlier this month, all New York employers must conduct annual sexual harassment training and have a compliant sexual harassment prevention policy effective October 9, 2018

On August 23, 2018, Governor Cuomo issued an executive order containing a draft model sexual harassment policy (including a draft model complaint form) and a draft model sexual harassment training program

While the model sexual harassment prevention policy and training provide useful guideposts for employers in New York, it bears emphasis that the model policy and training are still in draft form, and are subject to public comment from employers and interested stakeholders until September 12, 2018. 

Herrick will continue to monitor updates concerning the final versions of the draft models and any newly issued guidance. In the meantime, employers should continue to evaluate their current anti-harassment policies and trainings in light of this new draft guidance and contact their employment counsel if they have any questions concerning compliance with New York’s upcoming deadlines.
