Panel Tosses Damages, Fine for Owner Who Denied Ramp

Herrick partners Avery Mehlman and Jonathan Adler were mentioned in The New York Law Journal for their work representing property owner Marine Holdings, LLC in a successful appeal against the NYC Commission on Human Rights. A panel of the Appellate Division reversed the commission’s order for Marine Holdings to pay $185,000 for denying a tenant's request to construct a handicapped-accessible entrance to her Queens apartment, writing that the record lacked "substantial evidence" to contradict Marine Holdings’ claim that installing an accessible entrance was not structurally feasible. In the article, Mehlman noted that “The commission relied upon an architect who had never visited the site nor conducted a full review of the structural feasibility of the requested accommodation.”
